بررسی امکان تسری ترتیبات موافقت‌نامة امداد و نجات فضانوردان به گردشگران فضایی

چکیده
فضانوردان به عنوان فرستادگان بشریت در فضای ماورای جو همواره در معرض تهدیدهای گوناگون قرار دارند. از همین رو تکلیف به امداد و نجات فضانوردان و بازگرداندن آنان از همان ابتدای تلاش برای قاعده‌مند کردن استفادة انسان از فضای ماورای جو مورد توجه قرار گرفت و در معاهدۀ فضای ماورای جو به طور کلی و در موافقت‌نامۀ امداد و نجات به طور خاص به آن پرداخته شد. با وجود اینکه تا کنون مجالی عملی برای آزمودن ترتیبات مندرج در این اسناد دست نداده‌ است، اما به هر روی نمی‌توان اهمیت تعهد به نجات و بازگرداندن فضانوردان را به عنوان اهرمی اطمینان‌بخش در بسط و گسترش فعالیت‌های بشر در فضای ماورای جو نادیده انگاشت. در این میان گسترش روزافزون فعالیت‌های تجاری در فضای ماورای جو و جدی‌تر شدن حضور گردش‌گران فضایی، بحث قابلیت تسری مقررات موجود در موافقت‌نامه‌ی امداد و نجات به گردش‌گردان فضایی را صورت جدی مطرح نموده است که در این مقاله به بررسی زوایای گوناگون آن خواهیم پرداخت.
